Individuals who were determined to be owed payments pursuant to the settlement were sent checks on July 18, 2005. This is the final distribution under the Settlement. These checks are for more than the amount initially estimated in the original claim forms sent to class members. Additional money was available for distribution because of the successful efforts of class counsel, the trustee, and the service providers to keep administrative costs to a minimum.

Class members who filed a claim form by October 27, 2003, were sent a substantial percentage of their individual awards on December 10, 2003. Checks have now been sent for the balance of the amounts owed under the settlement. Class members in the database who submitted a claim form after October 27, 2003 but before October 27, 2004, have now been sent checks for their whole award.

Those who filed timely successful challenges or claims for class membership have now been sent checks for their complete award.

All eligible successors of deceased class members have now been sent checks for their complete award.

The deadline for filing a claim form has now passed. Note that the court-approved Settlement Distribution Plan does not allow for any exceptions to this October 27, 2004 deadline.

The Settlement Administrator will not provide information about individual award amounts over the telephone.

Please do not call the Settlement Administrator to ask about the status of your check. Checks were mailed on July 18. If you are entitled to receive a check and do not get it by July 31, call the Settlement Administrator after that date.
